ORDER
(Order of the Court was made by R. MAHADEVAN, J.) When the Contempt Petition was taken up for consideration, the learned counsel for the petitioners drew the attention of this court to the affidavit filed by the fifth petitioner on 17.08.2021, wherein, it is stated that the fourth respondent viz., Commissioner of Commercial Taxes, Chennai, vide CCT Letter No.CP3/11716/2018 dated 21.12.2020, invited objections to the provisional interse seniority list of Assistant Commissioner (CT) drawn vide G.O.Ms.No.185, CT & Regn (E1) Department, dated 16/12/2020 and this petitioner has also given a detailed representation. It is also stated therein that the fourth respondent in his counter affidavit dated 18.03.
2021, stated that the objections on the basis of violations of four principles / parameters confirmed by the Hon'ble Supreme Court, if any, will be duly considered and the petitioners are willing to await the outcome of the same and not to press the contempt of court proceedings against respondents. Further, the fifth petitioner extracted the paragraph 8 of the counter affidavit filed by the fourth respondent, which reads as under: ...8.
acted upon by the fourth respondent by revising the inter-se seniority lists in the cadre of Assistant Commissioners from the year 1984 onwards and orders to this effect have also been issued by the third respondent by giving wide publicity to the proposales by inviting objections...
It is further submitted that the respondents have received some objection to the recently published seniority lists of Assistant Commissioners, which are currently under examination, and discrepancies, if any that come to notice will be rectified, including taking necessary action to review the lists further" Placing reliance on the same, the learned counsel submitted that nothing survives for adjudication in this contempt petition.
2.Recording the above, this Contempt Petition stands closed. Consequently, connected sub application are also closed.
