ORDER
This writ petition has been filed challenging the impugned online rejection order dated 30.11.2023 and for a consequential direction to the respondents to deal with the representation made by the petitioner on 04.01.2025, wherein, the petitioner is seeking for an individual patta in her name.
2.Heard Mr.U.Gokulakrishnan, learned counsel appearing on behalf of the petitioner and Mr.M.R.Gokulkrishnan, learned Additional Government Pleader appearing on behalf of the respondents.
3/6 3.The petitioner is claiming her right and title over the subject property through a Will dated 05.03.2021 executed by her father in her favour. The petitioner submitted an application for mutation of revenue records and to issue separate patta in the name of the petitioner. The grievance of the petitioner is that the 3 rd respondent without assigning any reasons, issued the online rejection order. Aggrieved by the same, the petitioner made a representation and the same did not evoke any response. It is under these circumstances, the present writ petition came to be filed before this Court.
4.Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, this Court is of the view that if the 3 rd respondent is not inclined to issue separate patta in the name of the petitioner, an enquiry should have been conducted by giving an opportunity to the petitioner and a reasoned order should have been passed. Instead, the rejection order has been made without assigning reasons through online mode.
4/6 5.In view of the above, there shall be a direction to the 3 rd respondent to deal with the representation made by the petitioner on 04.01.2025 and conduct an enquiry after affording opportunity to the petitioner and pass appropriate orders, within a period of four weeks from the date of receipt of copy of this order.
