(CRIME NO.05 OF 2019) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to exempt the petitioner from surrendering for the sentence imposed on the petitioner made in the judgment dated 17.12.2021 made in Crl.A.49/2021 on the file of Principal Sessions Judge, Tiruppur Confirming the Judgment dated 30.07.2021 made in CC.483/2019 on the file of the Additional Mahila Court, Tiruppur and to release the petitioner on bail and thus render justice.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of MR.C.PRABAKARAN, Advocate for the petitioner and of M/S.LEONARD ARUL JOSEPH SELVAM, Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:- This petition has been filed to exempt the petitioner from surrendering for the sentence imposed on the petitioner made in the judgment dated 17.12.2021 made in Crl.A.No.49 of 2021 on the file of the Principal Sessions Judge, Tiruppur, confirming the judgment dated 30.07.2021 made in C.C.No.483 of 2019 on the file of the Additional Mahila Court, (Magisterial Level), Tiruppur.

2. Today, when this petition is taken up for hearing, the learned counsel appearing for the petitioner submits that the petitioner is surrendered on 28.03.2022 and hence he seeks permission of this Court to withdraw this petition. He has also made an endorsement in the court bundle to that effect.

3. In view of the endorsement made by the learned counsel appearing for the petitioner, this Criminal Miscellaneous Petition is dismissed as withdrawn.
