The petitioner had taken advantage of Section 372 of Indian Succession Act, 1925 and filed this Original Petition with respect to the terminal benefits receivable on account of the death of V.Anthony @ Anthony Venugopal, who was working in M/s. Tamilnadu Generation and Distribution Corporation Limited (TANGEDCO). He died on 03.10.2021. He died as a bachelor. Apart from the petitioner, who is his sister, it has been claimed that there are no other Class-II heirs. The mother predeceased him.

2. Paper publication was effected as required under the Rules. The petitioner examined herself as PW-1 and marked the death certificate of V.Anthony as Ex.P1 and the legal heirship certificate of V.Anthony as Ex.P2. The legal heirship certificate of the mother, viz., Valliyammal was marked as Ex.P3. Ex.P4 is the letter addressed by the TANGEDCO calling production of Succession Certificate for disbursement of the amounts to 1/3

the credit of the deceased viz., V.Anthony. The death certificate of Valliyammal was marked as Ex.P8. The paper publication as required under the Rules was marked as Ex.P9.

3. In view of the evidence produced, this Original Petition stands allowed and Succession Certificate is granted in favour of the petitioner. 22.09.2022 Maya 2/3
