CMP Nos.6364, 6374 and 6375 of 2021 have been filed by the petitioners i)to condone the delay of 2104 days in filing the petition to set aside the abatement caused due to the death of 5th respondent Jayajothi Rachutappa @ Baby; ii) to set aside the abatement caused due to the death of 5th respondent and iii) to bring on record the legal representatives of the deceased 5th respondent as respondents 17 and 18 in the above Second Appeal.

2. Heard Mr.D.Shivakumaran, learned counsel for the petitioners.

3. The learned counsel appearing for the respondents have no objection for allowing these petitions.

4. Having regard to the reasons stated in the affidavit filed in support of these petitions and this Court being satisfied with the same, these CMPs are allowed as prayed for.
