ORDER

The prayer in the writ petition is to issue a Writ of Certiorari to call for the records relating to the surcharge proceedings in Na.Ka.8119 of 2006 Sa Pa dated 08.10.2012 of the 1st respondent issued under Section 87 of the Tamil Nadu Co-op. Societies Act, 1983, quash the same.

2. It is brought to the notice of this Court by the learned counsel for the petitioner that the present writ petition, filed challenging the impugned surcharge notice dated 08.10.2012, has become infructuous for the reason that pending writ petition, another notice dated 03.09.2013 has been issued by the respondent authority and the petitioner has also been issued with the said show cause notice and the same was not challenged by the petitioner.

3. In view of the subsequent notice issued by the authority concerned, this writ petition is dismissed as having become infructuous with liberty to proceed with the subsequent notice dated 03.09.2013. Consequently, the connected miscellaneous petition is closed. No costs.
