A.No.4022 of 2016 in O.P.No.541 of 2010 M.M.SUNDRESH,J., This application has been filed to eschew the evidence of P.W.1 and permit the petitioner to let in evidence in O.P.No.541 of 2010 as fresh on the ground that P.W.1 after filing of proof affidavit has died.

2.Learned counsel appearing for the respondents do not have any objection for allowing this application.

3.Considering the submissions made and taking note of the fact that P.W.1 is yet to be cross examined, this application stands ordered.

4.Post the matter before the Master for recording evidence.
