The petitioner/wife seeks transfer of H.M.O.P.No.3282 of 2022 on the file of learned Principal Family Judge, Chennai to the Family Court, Chengalpattu and try along with F.C.O.P. No.282 of 2022. In fact, petitioner/wife filed a petition seeking for divorce and the respondent/husband filed a petition seeking for restitution of conjugal rights. He is residing at Chennai and she is residing in her parents house at Kancheepuram. The respondent is an employee in a private concern and he has also appeared before the Family Court, Chengalpattu.
2. The admitted fact that already the respondent appeared before the Family Court, Chengalpattu to contest the O.P. filed by petitioner/wife. Admittedly, she is residing at Kancheepuram District.
3. In view of the above, H.M.O.P.No.3282 of 2022 is withdrawn from the file of the Principal Family Judge, Chennai and transferred to the file of Principal Family Judge, Chengalpattu, to be disposed of in accordance with law and the learned Principal Family Judge, Chennai is directed to send 2 / 4
entire records to the learned Family Court, Chengalpattu within a period of six weeks from the date of receipt of copy of this order. Accordingly, this Tr.C.M.P.No.207 of 2023 is allowed. No costs. Consequently, connected miscellaneous petition is closed.
