ORDER : The Court Made the following order :- The petitioners herein/A3 and A4 were found in possession of 10,500 Kgs of PDS rice in 210 gunny bags. They were intercepted while transporting the PDS rice in Maruthi Omini Car bearing registration No.PY 01-X-4559.

2. The learned counsel for the petitioners states that the petitioners are loadman and they were engaged by the first accused for loading and unloading the PDS rice and they were not aware that it is PDS rice. These petitioners were arrested on 22.02.2022. Though the petitioners stated that they were not aware of content of the bag, as of now the owner of the Maruthi Omini Car is still absconding and yet to be apprehended. Unless he is arrested, whether the petitioners accompanied the PDS rice with knowledge or not, will not come to light. Since the investigation is at the initial stage and the quantity of the contraband PDS rice seized is very high, this Court is of the opinion that the release of these petitioners at this juncture will tamper the investigation. Hence, this Criminal Original Petition for bail is dismissed.
