Respondents Prayer: Writ Petition filed under Article 226 of Constitution of India for the issuance of Writ of Mandamus, directing the fourth respondent to give supply of electricity to the premises situated in survey No. 52/1A, Nelvoy Village, Vellore Taluk and District in Service Connection No. 20008230022567. ORDER
This writ petition is filed with a prayer to direct the fourth respondent to grant electricity supply to the premises situated in Survey No. 52/1A, Nelvoy Village, Vellore Taluk, and District, under service connection No. 20008230022567.
2. The grievance of the petitioner is that earlier, when the crusher unit was run and it was closed down, the connection was surrendered. Now, the petitioner wants to restart the activities, but when the electricity supply was sought to be restored, the same has not been considered due to the objections of one of the co-owners.
3. This writ petition is disposed of at the admission stage, without notice to the fifth respondent, as none of the rights of the parties are decided in the writ petition.
4. When the matter came up for admission, the learned counsel 2/5
appearing for the respondents 1 to 4 submitted that, as per the terms of supply, either the consent of the co-owner or, in the absence of consent, an indemnity bond ought to have been uploaded. In this case, if the petitioner uploads the indemnity bond, it will be duly considered in accordance with the law. There is also another condition to pay the enhanced security deposit.
5. In view thereof, this writ petition is disposed of on the following terms:- (i) The rights of the fifth respondent shall no way affected by this order.
(ii) The petitioner shall upload the indemnity bond and also pay the demand for the enhanced security deposit. Upon payment and uploading the indemnity bond, the prayer of the petitioner shall be considered in accordance with the law, and the connection shall be effected as expeditiously as possible, in any event, not later than six weeks from the date of receipt of the web copy of the order, without waiting for the certified copy of the order. No costs.
