ORDER
This writ petition has been filed to forbear respondents 1 to 3 from conducting survey of the property, morefully disclosed in the prayer to this writ petition until the disposal of the civil suits in O.S.Nos.85 of 2015 and 26 of 2017 on the file of the District Munsif Court, Hosur. 2.The petitioner had given a representation on 22.07.2025 to respondents 1 to 3 seeking for the relief as prayed for in this writ petition. Since the said representation was not considered, the petitioner has filed this writ petition. 3.Mr.C.Jayaprakash, learned Government Advocate accepts notice on behalf of respondents 1 to 3. Since no adverse order is being passed against the fourth respondent, notice to the fourth respondent is dispensed with by this Court.
4.According to the petitioner, since the aforesaid civil suits are pending between the petitioner and the fourth respondent, the request of the fourth respondent to survey the property, morefully disclosed in the prayer to this writ petition, cannot be accepted by the official respondents. Instead of raising the objections before the revenue authorities, the petitioner has filed this writ petition before this Court. On receipt of the summons from the second respondent, necessarily, all the objections that have been raised in this writ petition will have to be raised only before the RDO at this stage. Necessarily, the second respondent will have to consider the objections raised by the petitioner, on merits and in accordance with law.
5.This Court is not expressing any opinion on the merits of the petitioner's objections.
6.For the foregoing reasons, this writ petition is disposed of by directing the second respondent to consider all the objections raised by the petitioner, which includes the pendency of the civil suits, namely O.S. Nos.85 of 2015 and 26 of 2017 on the file of the District Munsif, Hosur between the petitioner and the fourth respondent before taking a final decision on the fourth respondent requesting for survey and demarcation of the boundaries of the property, morefully disclosed in the prayer to this writ petition.
