When the case was taken up for hearing on 20.08.2024, the learned counsel for the appellant submitted that the sole appellant has passed away, and they sent case papers to the legal representatives of the deceased, sole appellant and requested time to get instructions from the legal heirs of the deceased, sole appellant.

2. Today, 04.09.2024, when the matter was taken up for hearing, the learned counsel for the appellant submitted that she has no instructions from his client to pursue the case, and she also made an endorsement to that effect in the case bundle.

3. In view of the submission coupled with the endorsement made by the learned counsel for the appellant, this second appeal stands dismissed as abated. No costs.
