in I.P.No.4 of 2023 KRISHNAN RAMASAMY, J., This application has been filed to annul the order of adjudication dated 30.03.2023 adjudicating the debtor D.Raja as insolvent in I.P.No.4 of 2023.
2. The learned counsel for the applicant would submit that all the creditors have been settled out of Court. Hence, he prays this Court to allow this application.
3. The learned Official Assignee would submit that the applicant was declared as insolvent on his own petition vide order passed by this Court on 30.03.2023, however, no claims were received against him so far. In this regard, he had also filed a detailed report dated stating that the notices have been sent to all the 6 creditors, out of which, 2 unsecured creditors have been duly acknowledged and 4 notices were returned 1/3
unserved. Only one creditor had attended the creditors meeting on 09.08.2023, however, no claim was received till date.
4. In reply, the learned counsel for the applicant would submit that since the creditors have been settled out of Court, no claims have been received by the Official Assignee.
5. Taking into consideration of the submissions made by the applicant and the report filed by the Official Assignee, this Court is satisfied and is inclined to allow this application.
6. Accordingly, this application is allowed. Thus, the order of adjudication dated 30.03.2023 is hereby annulled 26.04.2024 nsa 2/3
