This writ petition has been filed for the issue of writ of mandamus directing the first and second respondents to consider the representation made by the petitioner on 21.10.2019. 2.

The case of the petitioner is that the third respondent is a neighbour who has encroached upon the property belonging to the Government by fabricating the documents. The petitioner wants the sale deed executed by the third respondent to be cancelled.

In the considered view of this Court, the official respondents do not have any right or authority to cancel any sale deed and it is a relief which can be granted only by a civil Court. If the petitioner is so aggrieved, he can always go before the civil Court and challenge the sale deed executed by the third respondent. Therefore, no useful purpose will be served in directing the official respondents to consider the representation made by the petitioner. This Court does not find any merits in the writ petition. Accordingly, the same is dismissed. No costs.
