and W.P.Nos.28401 and 28405 of 2021 THE HONOURABLE CHIEF JUSTICE and D.BHARATHA CHAKRAVARTHY, J (The Order of the Court was made by The Honourable Chief Justice) An application in W.M.P.No.5838 of 2022 in W.P.No.10666 of 2019 has been filed to seek recall of the order, dated 03.03.2022. The order aforesaid was passed recording the statement by the respondents that the encroachment has been removed.

2. The learned Additional Advocate General appearing for the official respondents submits that under some confusion or understanding, the statement aforesaid was made. In fact, the encroachment is yet to be removed.

3. In view of the facts given above, the order dated 03.03.2022 is recalled, recording the above statement of the learned Additional Advocate General. Accordingly, W.M.P.No.5838 of 2022 is allowed. 1 / 3

4. However, it is with the direction to the respondents to come out with action taken report regarding the representation made by the petitioners. The action taken report would contain the details of the action taken by them to remove the encroachment and details of such encroachments. The respondents, would even conduct a survey and demarcate the land to exactly identify the encroached area and the encroachers therein, with immediate follow up action to remove the encroachment.

5. List W.P.Nos.10666 of 2019, 28401 of 2021 and 28405 of 2021 for hearing on 22.04.2022.
