A.No.974 of 2022 in C.S.No.430 of 2019 P.VELMURUGAN.,J This Application has been filed to transpose the second plaintiff as one of the defendants, namely the third defendant in the Suit in C.S.No.430 of 2019.

2. The first plaintiff wanted to proceed with the case as sole plaintiff, since the second plaintiff is not co-operating to continue the suit with him. Hence, the first plaintiff/applicant has moved this application.

3. Since the respondents' counsel has no serious objection to allow this application and also on being satisfied with the reasons stated in the accompanying affidavit, this Application is allowed.

4. Learned counsel for the plaintiff is directed to carry out the amendment and file the amended copy of the plaint within a week.

5. The Registry is directed to place the matter before the Assistant Registrar (O.S-I), for serving summons to the proposed third defendant and list the Suit on 30.03.2022.
