Respondent Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondent to pay interest on the belated payment of retirement benefits including DCRG, Provident Fund etc., and interest on arrears of pension for the period of 23.04.2013 to 10.04.2024 at the rate of 12% per annum payable from the date of death of the petitioner's husband on 23.04.2013 to the actual date of payment based on the representations dated 18.04.2024 and 20.04.2024 made by the petitioner.

ORDER

This Writ Petition has been filed in the nature of a Mandamus seeking a direction to pay interest on the delayed payment of retirement benefit including DCRG, Provident Fund, interest on arrears of pension for the period from 23.04.2013 till 10.04.2024.

2.The husband of the petitioner who was working as driver under the respondent had died while in service on 23.04.2013. Earlier his services had been terminated on 01.11.1994, but he was reinstated consequent to orders in W.A.No.1123 of 2013 which was flowed from an award of Labour Court and order of the Writ Petition. The petitioner, unfortunately, died on 23.04.2013 while in service. The family pension was paid with much delay. Heard both sides.

A direction is given to the respondents to examine the date on which the retirement benefits / family pension were actually paid and if it had been paid with delay pay the same with interest at 6% per annum from the date on

which the eligibility arose / death of the husband of the petitioner till the date of actual disbursement. The entire exercise must be completed within a period of three months from the date of receipt of a copy of this order. Accordingly, this Writ Petition stands disposed of.
