This writ petition has been filed for direction to the respondents to sanction, draw and disburse the arrears of pension due to the petitioner's father.

Heard, the learned counsel appearing on either side. 3.

The petitioner's father retired from the service while working at Tirupur Municipality on 03.07.1970 on attaining the age of superannuation. The petitioner is also a retired employee. While the petitioner's father was alive, he was drawing pension. After period of 42 years, the petitioner is now claiming arrears of pension of his late father. Admittedly, the petitioner's father while he was alive, was receiving pension. Therefore, if at all any arrear of pension, his father would have claimed. As such, the claim of the petitioner cannot be considered after period of 42 years and this writ petition is devoid of merits. 2/4

Accordingly, this writ petition is dismissed. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
