This petition has been filed to condone the delay of 134 days in filing the above appeal.

Mr.C.R.Sureshkumar, learned counsel, who takes notice for the respondent, fairly submits that he has no serious objection to the delay of 134 days being condoned subject to the condition that the petitioner forfeits interest for the delay period of 134 days.

In view of the above submission made by the learned counsel for the respondent, the delay of 134 days is condoned on condition that the petitioner forfeits interest for the delay period.

The Registry is directed to number the appeal, if it is otherwise in order and post the same for admission. The Registry is further directed to print the name of the learned counsel for the respondent in the cause list at the time of admission.
