ORDER

This writ petition has been filed seeking for issuance of No Objection Certificate (NOC) by the respondent for registration of a Gift / Dedication Deed

in respect of the portion of land comprised in Survey No. 478, for public pathway use, within a time frame to be fixed by this Court.

2. The petitioner and other co-owners have voluntarily decided to contribute an extent of approximately 0.05 acres in Survey No. 478, Pernambut Village, Pernambut Taluk, Vellore District, bearing patta No.4014 to an extent of 0.13.23 hectares as a public pathway, connecting the old Erukkambattu Road with adjacent lands for public welfare, without any consideration.

3. All the co-owners, including the petitioner, executed a permanent agreement dated 10.09.2022, consenting to surrender and in future not claim any right over the portion donated for public pathway. The petitioner submitted an application dated 29.01.2026 to the respondent along with supporting documents, seeking for issuance of a No Objection Certificate, to enable the registration of the Gift / Dedication Deed in favour of the respondent Municipality.

4. According to the petitioner, till date, the respondent has not issued the No Objection Certificate. In such circumstances, the petitioner has filed this writ petition.

5. Dr. T. Sreenivasan, learned Special Government Pleader accepts notice on behalf of the respondent.

6. No prejudice would be caused to the respondent if the petitioner's

representation dated 29.01.2026 is considered on merits and in accordance with law, seeking for issuance of No Objection Certificate to enable the registration of the Gift / Dedication Deed in favour of the respondent Municipality within a time frame fixed by this Court.

7. For the foregoing reasons, this writ petition is disposed of by directing the respondent to pass final orders on merits and in accordance with law on the petitioner's application dated 29.01.2026, seeking for issuance of No Objection Certificate to enable the petitioner and other co-owners to register a Gift /Dedication Deed in favour of the respondent Municipality for the purpose of public pathway, in respect of the property morefully described in the prayer to this writ petition, after giving due consideration to the supporting documents filed by the petitioner, within a period of eight weeks from the date of receipt of a copy of this order. No costs.
