This application has been filed to bring on record Mr.R.Janarthanam and show him as a Proprietor of the 2nd defendant, Narmadha Pathipagam. 2.When the suit was instituted, the 2nd defendant, Narmadha Pathipagam was represented by T.S.Ramalingam who has been shown as 1st defendant. Pending the suit T.S.Ramalingam, 1st defendant had unfortunately died. The Proprietorship firm Narmadha Pathipagam is now being run by Mr.R.Janarthanam S/o. of T.S.Ramalingam. 3.It would only be appropriate that he is also made a party, representing the 2nd defendant in his capacity as proprietor.

4. In view of the above, this application is allowed. 5.It must also be noted that the counsel for the 2nd defendant is also present.

smv 6.The Registry may carryout necessary amendment in the plaint by incorporating the name of R.Janarthanam and show him as a proprietor of the 2nd defendant, Narmadha Pathipagam.

7.The learned counsel for the plaintiff may also file an amended plaint copy. The learned counsel for the 2nd defendant may file a fresh vakalat duly executed by R.Janarthanam, in his capacity of proprietor of Narmadha Pathipagam.
