Petition under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, to direct the 1st and 2nd respondents to consider the petitioner's representation dated 31.10.2022 and remove the encroachment made in S.Nos.435, 436, 430/2, Devarmukkulam Village, Karadihalli Panchayath and Village, Krishnagiri Taluk and Krishnagiri District measuring about 24 acres.

ORDER
(Order of the Court was made by the Hon'ble Acting Chief Justice) The present writ petition seeking issuance of a mandamus to the 1st and 2nd respondents to consider the petitioner's representation dated 31.10.2022 for removal of the encroachment made in S.Nos.435, 436, 430/2, Devarmukkulam Village, Karadihalli Panchayath and Village, Krishnagiri Taluk and Krishnagiri District measuring about 24 acres, cannot be entertained, since the petitioner has to submit his representation only to the officer of the H.R. & C.E. Department, instead he has given the representation to the District Collector and the Tahsildar of Krishnagiri District, who have no role. Therefore, the writ petition is dismissed.
Needless to mention that it is open to the authorities concerned to take appropriate action, if there is any encroachment made in the land in question, as per law. There shall be no order as to costs. Speaking/Non speaking order (T.R.,A.C.J.) (D.B.C.,J.) Index : yes/no 16.03.2023 ss To
