The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences under Sections 447, 427, 384 and 506(ii) IPC in Crime No.137 of 2013 on the file of the respondent police, seeks anticipatory bail.

2. Petitioner is A2. The petitioner is facing trial in C.C.No.137 of 2013 on the file of the learned Judicial Magistrate II, Mannargudi. Since he failed to appear before the trial court, NBW was issued against him. Hence, he filed the present petition for anticipatory bail. 3.Learned counsel for the petitioner submitted that since the petitioner went to abroad on account of his avocation, he was not able to appear before the trial court. Now he undertakes to appear before the trial court without any default and would co-operate with the trial and prays for an order.

4.Learned Government Advocate (Criminal Side) would submit that NBW has been issued against this petitioner C.C.No.137 of 2013 on the file of the learned Judicial Magistrate II, Mannargudi since 23.7.2013. 5.Considering the facts and circumstances of the case and considering the fact that Non-Bailable Warrant is pending against the petitioner herein, this Court is constrained to direct the petitioner to

kal appear in person to file a petition under Section 70(ii) of Cr.P.C. for recalling the Non-Bailable Warrant before the learned Magistrate and in the event of filing such an application, the learned Judicial Magistrate II, Mannargudi, is directed to consider the same, and pass orders on merits and in accordance with law on the same day.

6.The trial court is directed to dispose of the case in C.C.No.137 of 2013, is pending on its file, as expeditiously as possible, without adjourning the matter beyond five working days at any point of time and the petitioner shall co-operate with the trial.
