Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 4th respondent to instruct the surveyor to take suitable action on the representation dated 16.12.2020 of the petitioner

to survey the land of the petitioner situated at New T.S.No.27, old T.S.No.61/1A, Block-61, Ward-J, to an extent of 28,000 Sqft, Mullavadi Railway gate, Salem and secure the same by laying fence across the borders from unauthorised occupiers. ORDER

This Writ Petition is filed for a writ of Mandamus, directing the 4th respondent to instruct the surveyor to take suitable action on the representation dated 16.12.2020 of the petitioner to survey the land of the petitioner situated at New T.S.No.27, old T.S.No.61/1A, Block-61, Ward-J, to an extent of 28,000 Sqft, Mullavadi Railway gate, Salem and secure the same by laying fence across the borders from unauthorised occupiers. 2.Mr.G.Rajesh, learned Government Advocate entered appearance for the respondents 1 to 4 and submitted that an enquiry is scheduled to take place on 08.06.2021 at 11.00 a.m at the office of the fourth respondent/Tahsildar. 3.The said statement of the learned Government Advocate is recorded.

4.In view of the above, no further direction is required to be given except that the fourth respondent is directed to issue notice to all the parties who are likely to be affected by his decision, provide them a fair and effective hearing and to dispose of the matter through a speaking order within a period of twelve (12) weeks from 08.06.2021.
