PRAYER: This criminal miscellaneous petition has been filed under Section 528 of the BNSS Act to modify the condition imposed as to deposit a sum of Rs.4,00,000/- (Rupees Four Lakhs Only) to the credit of concerned Magistrate in order to comply the direction imposed by this Hon'ble Court in Crl.M.P.No.18706 of 2023 in Crl.O.P.No.16151 of 2023 dated 30.11.2023.

ORDER

The petitioner seeks modification of the condition imposed as to deposit a sum of Rs.4,00,000/- (Rupees Four Lakhs Only) to the credit of the concerned Magistrate in order to comply with the direction imposed by this Hon'ble Court in Crl.M.P.No.18706 of 2023 in Crl.O.P.No.16151 of 2023 dated 30.11.2023.

2. Heard both sides.

3. Since the earlier condition to deposit Rs.5,00,000/- (Rupees Five Lakhs only) was subsequently modified, directing the petitioner to deposit Rs.4,00,000/- (Rupees Four Lakhs only), and even that has not been complied with, this Court is not inclined to modify the condition imposed on the petitioner.
