The Civil Miscellaneous Petition has been filed, seeking to condone the delay of 953 days in paying the deficit court fee of Rs.151/-
2. In the affidavit filed in support of the Civil Miscellaneous Petition, it had been stated that, when the appeal was filed, the Court fees had been miscalculated as Rs.5,000/-. It was an appeal against a decree in a partition suit. It had been omitted to value the appeal and pay necessary court fees for the other consequential reliefs, for which, the necessary court fee is Rs.151/- In making payment of the court fee of Rs.151/-, there had been a delay of 953 days. It had been stated that a large portion of the delay was during the lock down period owing to COVID-19 Pandemic.
3. In view of the particular reason stated, the delay of 953 days in paying the deficit court fee stands condoned and this petition is allowed. 1/2 https://www.mhc.tn.gov.in/judis
