O R D E R

(Order of the Court was made by K.K.SASIDHARAN, J.,) The respondent filed the Original Application before the Madras Bench of the Central Administrative Tribunal in O.A.No.233/2011. The challenge was to the order dated 21.10.2009 revising the pension.

The Tribunal, following the earlier order dated 20.06.2011 in O.A.Nos.1188 and 1189/2010, allowed the Original Application and a direction was issued to the petitioners to fix the pay of the respondent, taking into consideration, 55% of add-on element of basic pay, instead of 30%, which has been granted to him. There was a further direction to work out the pension payable to the respondent. The Tribunal, accordingly, modified the order dated 21.10.2009.

3. The issue raised by the respondent before the Tribunal has already been decided against the petitioners in O.A.Nos.1188 and 1189/2010. The Memorandum of Grounds of Appeal does not contain any indication that the order dated 20.06.2011 in O.A.Nos.1188 and 1189/2010 was taken up for judicial review either before the High Court or before the Honourable Supreme Court. Since the issue has already been decided in the earlier Original Application, the Tribunal was perfectly justified in following the order in the subsequent application filed by the respondent. We therefore do not find any reason to set aside the order passed by the Tribunal.
