In compliance of the order dated 10.10.2022 passed in C.M.P.No.16017 of 2022, the appellant has effected paper publication in one issue of Tamil Murasu dated 14.10.2022. Therefore, there is a deemed service on the 2nd respondent.
2. C.M.P.No.6095 of 2021 has been filed for impleading the 2nd respondent on whom service has been effected through substituted service. The reason for seeking to implead the 2nd respondent is on the ground that pending the suit the 1st respondent has settled the property in favour of the 2nd respondent, who is none other than his mother under a settlement deed dated 24.09.2004, registered as a document No.3256 of 2004 on the file of the Office of the Sub-Registrar, Villianur. Therefore, in order to avoid multiplicity of proceedings, the appellant seeks to implead the 2nd respondent as party to the proceedings.
