ORDER
(Made by the Hon'ble Chief Justice) We have heard Mr.G.Jeremiah, learned counsel for the petitioner and Mr.A.Edwin Prabakar, learned State Government Pleader assisted by Mr.T.K.Saravanan, learned Government Advocate for the respondents.
2. Learned counsel for the petitioner submits that an appeal dated 09.04.2019 under Section 10 of the Land Encroachment Act, 1905 has been filed before the second respondent, however the same is not yet decided.
3. In case the appeal is filed by the petitioner under Section 10 of the Land Encroachment Act, 1905 and if the same is pending before the second respondent, then the second respondent shall decide the same on its own merits and in accordance with law preferably within four months from the date of appearance of the petitioner. The petitioner shall appear before the second respondent on 24.04.2024.
4. With the above observation, the writ petition is disposed of. There shall be no order as to costs.
