ORDER

The petitioner, who was arrested and remanded to judicial custody on 07.11.2025 for the offences punishable under sections 376, 506(ii) of IPC in Crime No.50 of 2014 in S.C.No.152 of 2016 on the file of the respondent police, seeks bail.

2. The petitioner was earlier arrested and released on bail and he was regularly appearing before the Sessions Court. Subsequently, he jumped bail on 28.04.2025, and the Non Bailable Warrant was executed on 07.11.2025. Hence, the case.

3. The learned counsel for the petitioner submitted that though it is stated that the petitioner was irregular in appearing before the Trial Court, he was having a heart ailment and hence, he was not able to appear before the Trial Court and now is ready to co-operate with the trial process. Hence prayed for grant of bail.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner has continuously dragged on the trial and the sessions case is of the year 2016 and now the case is posted for examination of investigation officer and the trial Court also recorded the bail dismissal order that the petitioner is 5th time absented himself and recalled warrant. Hence, he opposed to grant bail to the petitioner.

Though it is stated that the petitioner was irregular and he was not in a position to appear before the Trial Court owing to the health condition, the order of the Trial Court revealed that the petitioner is continuously involved in jumping bail and delayed the trial process and it is also recorded after lapse of 7 months the petitioner has been arrested.

6. Considering the above facts, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed. 19-02-2026 MPA To 1.State by Inspector of Police AWPS Tambaram Police Station, SC.No. 152/2016.
