ORDER

This Civil Revision Petition has been filed seeking to set aside the fair and decretal order dated 05.02.2026 made in IA.No.16 of 2025 in OS.No.3321 of 2019 on the file of the VI Additional Judge, City Civil Court, Chennai.

2. The learned counsel for the petitioner submits that the petitioner has filed I.A No. 16 of 2023 in OS No. 3321 of 2019 seeking to implead Government officials as necessary parties in the suit. While disposing the said application the Trial Court instead of disposing I.A No. 16 of 2023 it disposed of I.A No. 10 of 2023 which was filed for restoration of suit long back. Hence he prays to set aside the order passed in IA.No.16 of 2025 in OS.No.3321 of 2019 on the file of the VI Additional Judge, City Civil Court, Chennai.

3. Heard the submission of the learned counsel for the petitioner and perused the material available on record. Admittedly, as on date, suit is restored and the case is posted for cross examination. In fact, I.A No. 16 of 2025 was filed to implead the proposed parties. However, in stead of passing order in I.A No. 16 of 2025 the Trial Court passed order in I.A No. 10 of 2025, as such is erroneous and liable to be set aside. Accordingly, I.A No. 16 of 2025 in OS.No.3321 of 2019 is restored. Liberty granted to the petitioner to approach

the Trial Court. The VI Additional Judge, City Civil Court, Chennai is directed to dispose of I.A No. 16 of 2025 within a period of 2 weeks from the date of receipt of a copy of this order.

4. In the result, this Civil Revision Petition is allowed. No Costs. Pending petition, if any is closed.
