Jayabalan Respondents Prayer:- This Second Appeal has been filed, under Section 100 of CPC, against the judgement and decree, dated, 03.08.2012 passed in AS.No.5 of 2012 by the Subordinate Judge, Chidambaram, reversing the judgement and decree, dated, 29.09.2008, passed in OS.No.54 of 2005, by the Additional District Munsif, Chidambaram.

Mr.A.Muthukumar JUDGEMENT The learned counsel for the Appellant submits that the sole appellant died as early as on 27.02.2019 and this Second Appeal is already abated and that therefore, this Second Appeal may be dismissed, as abated and he has also reported "No instructions from the parties" and has also made an endorsement to that effect. In view of the said submissions, recording the endorsement made by the learned counsel for the Appellant, this Second Appeal is dismissed, as abated. No costs.
