ORDER
This writ petition has been filed challenging the impugned notice, dated 06.02.2026 issued by the 3rd respondent, calling upon the petitioner for enquiry based on the corrected FMB sketch issued on the request made by the private respondents, namely the respondents 4 to 6.
2. Mr.D.Ravichander, learned Special Government Pleader, accepts notice on behalf of the respondents 1 to 3 and Mr.G.Prabakaran, learned counsel, accepts notice on behalf of the respondents 4 to 6.
3. The apprehension of the petitioner in this writ petition is that the FMB sketch for the property morefully disclosed in the affidavit filed in support of this writ petiton ought not to have been corrected as prayed for by the private respondents. Therefore, according to the petitioner, erroneouly and illegally, FMB sketch of the property has been corrected by the official respondents. The petitioner has filed supporting documents along with this writ petition. Based on the corrected FMB sketch, the 3rd Page No.2 of 6
respondent has called the petitioner for enquiry through the impugned notice, dated 06.02.2026. The enquiry is scheduled to take place on 17.02.2026. Necessarily, the objections of the petitioner as raised in this writ petition as well as the supporting documents filed by the petitioner will have to be considered by the 3rd respondent before the 3rd respondent takes a final decision.
4. The learned counsel appearing for the respondents 4 to 6 has also not raised any serious objection if the objections of the petitioner as raised in this writ petition along with supporting documents filed by the petitioner is considered by the 3rd respondent on merits and in accordance with law before passing the final orders on the request made by the respondents 4 to 6 in the enquiry to be scheduled for hearing on 17.02.2026.
5. This Court is not expressing its opinion on the merits of the respective contentions.
6. After hearing the rival submissions, this Writ Petition is disposed of by directing the 3rd respondent to consider the petitioner's Page No.3 of 6
objections with regard to the correction of the FMB sketch for the property morefully disclosed in the affidavit filed in support of this writ petition, made on the request of the private respondents, namely respondents 4 to 6, after giving due consideration to the supporting documents filed by the petitioner and also after hearing the contentions of the respondents 4 to 6, within a period of twelve (12) weeks from the date of receipt of a copy of this order. No costs. Consequently, the connected miscellaneous petition is closed.
