Respondents PRAYER : Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus to direct the 2nd respondent to issue NOC for installation of bill boards in line with the licence issued by the 1st respondent in Licence No.1 of 2025 dated 13.02.2025 and License No.02/ 2025 dated 17.03.2025.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) Heard.

2. The petitioner's grievance is that, though the petitioner has made representation seeking permission of the State Highways authority for putting up billboards, the said representation has remained pending without any decision.

3. Learned State counsel brings to the notice of this Court that such permission can be granted only if proper application in the prescribed format as provided under Section 26 of the Tamil Nadu Highways Act read with Rule 6 of the Rules framed thereunder is submitted with necessary particulars before the competent authority.

4. What we find is that a bare representation has been submitted

by the petitioner. Therefore, the petitioner may now submit an application in the prescribed format containing necessary particulars indicated therein before the competent authority in accordance with the provisions of Section 26 of the Tamil Nadu Highways Act read with Rule 6 of the Rules framed thereunder.

If such application is submitted, the competent authority shall take a decision within a period of six weeks thereafter. With the above observation and direction, the writ petition is disposed of.
