ORDER
The petitioner, who was arrested and remanded to judicial custody on 27.11.2025 for the offences punishable under sections 241, 307, 506(ii) IPC in Crime No.790 of 2007 in P.R.C.No.161 of 2019 on the file of the respondent police, seeks bail.
2. The petitioner was earlier arrested and released on bail. Subsequently, during the PRC stage the petitioner was absconded on 17.12.2024, and the Non Bailable Warrant was executed on 27.11.2025. Hence, the case.
3. The learned counsel for the petitioner submitted that the petitioner was not served with the summons in the PRC hence he was not able to appear before the trial Court and is ready to co-operate with the trial process. Hence prayed for grant of bail.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner was earlier arrested and released on bail and appeared in the PRC stage also for some period and thereafter he absconded and now the case is pending for committal. Hence, he opposed to grant bail to the petitioner.
5. Considering the fact that pendency of the committal proceedings is pending due to the petitioner's abscondence and since delay of abscondence is nearly one year, this Court is not inclined to grant bail to the petitioner.
