ORDER
The instant writ petition is filed for a Writ of Mandamus, directing the respondent in whose hand the petition dated 14.06.2011 is pending to consider the case of the petitioner, as requested for in the said petition as quasi judicial officer and to do the needful to the petitioner based on the Rules and Regulations.
2. The brief facts are as under:
The petitioner was appointed as Peon in Tamil Nadu Circle Postal Co-operative Bank Ltd., Chennai on temporary basis and on consolidated pay of Rs.1,000/- per month and was absorbed on regular basis, with effect from 01.01.1998. The petitioner sought for leave on medical grounds, with effect from 20.12.2003. The petitioner reported for duty on 18.06.2009, after recovery from his ailment. He was removed from service with effect from 29.10.2005. The petitioner has challenged the https://hcservices.ecourts.gov.in/hcservices/
order of removal by filing an appeal to the President, Tamil Nadu Circle, Postal Co-operative Bank Ltd., Chennai, on 18.06.2009. The appeal is said to be pending.
3. Since the appeal has not been disposed of, the petitioner has filed the instant writ petition with the above mentioned prayer.
4. Admittedly, the appeal filed by the writ petitioner, is still pending with the President, Tamil Nadu Circle, Postal Cooperative Bank Ltd., Chennai, from 18.06.2009. No orders have been passed on the said appeal, even after lapse of 10 years.
5. The writ petition is disposed of by directing the respondent to direct the President, Tamil Nadu Circle, Postal Co-operative Bank Ltd., Chennai, to dispose of the appeal filed by the petitioner, pending before it, within a period of three months, from the date of receipt of a copy of this order. No Costs. Consequently, the connected writ miscellaneous petitions, are closed.
