APPLICATION NOs.4082 to 4087 of 2016 IN C.S.NO.886 of 2010 PUSHPA SATHYANARAYANA, J These applications have been filed by the applicant / plaintiff to condone the delay of 378 days in filing the petition to set aside the abatement caused due to the death of the first defendant; to condone the delay of 378 days in filing the petition to set aside the abatement in A.No.6057 of 2010 in C.S.No.886 of 2010; to set aside the abatement of the first defendant; to set aside the abatement in A.No.6057 of 2010 in C.S.No.886 of 2010; to permit the plaintiff to bring on record the legal heirs of the deceased first defendant viz., the respondents 3 to 6 herein as proposed defendants 3 to 6; and to permit the applicant / plaintiff to bring on record the legal heirs of the deceased first defendant viz., respondents 3 to 6 as respondents 3 to 6 in Application No.6057 of 2010 in C.S.No.886 of 2010.

2. Heard the learned counsel appearing for the applicant and learned counsel appearing for the second defendant. Though notice was served on the proposed respondents and their names are also printed in the cause list, there is no appearance either in person or through Counsel.

3. Being satisfied with the reasons stated in the affidavit filed in support of these applications, the delay is condoned and the applications are allowed.
