K.P.Kavinilavu v. R.Venkatesan
IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED: 31.01.2017
CORAM:
THE HONOURABLE MRS.JUSTICE PUSHPA SATHYANARAYANA C.R.P.(PD).No.269 of 2017 K.P.Kavinilavu .. Petitioner Vs.
R.Venkatesan .. Respondent Civil Revision Petition filed under Article 227 of the Constitution of India praying to direct the Family Court, Salem to dispose of F.C.O.P.No.485 of 2013 within a stipulated time that may be fixed by this Court.
For petitioner : Mr.R.Nalliyappan
ORDER
The revision is filed by the wife in a matrimonial dispute who has filed a petition for dissolution of marriage. The trial has commenced on 10.12.2014 and the petitioner was examined in chief. Thereafter, it has been posted for cross-examination of P.W.1 from January 2015. Till today, the cross-examination of P.W.1 has not yet been completed, though once it was closed and reopened at the instance of the respondent-husband. Hence, the revision has been filed by the wife seeking a direction to the
Family Court, Salem to dispose of F.C.O.P.No.485 of 2013 within a fixed time frame. Considering the docket orders that have been filed along with the revision, the learned Judge seems to have allowed the crossexamination of P.W.1 for more than two years, which is a sheer waste of time and he ought not to have done so, especially in a family dispute. Hence, this Court is inclined to direct the learned trial Judge to dispose of the said F.C.O.P. Accordingly, the learned Judge, Family Court, Salem is directed to dispose of F.C.O.P.No.485 of 2013 before 30.04.2017. With this direction, the Civil Revision Petition is disposed of. No costs. 31.01.2017 cs Copy to The Judge, Family Court, Salem.
