O.A.No.233 of 2024 in C.S.No.693 of 2016 P.B.BALAJI, J., This Original Application has been filed to restrain the defendants 3 to 7 from alienating B Schedule property.

2.Pending disposal of the suit, Section 52 of the Transfer of Property Act, 1882, prohibits transfer of any interest in immovable property subsequent to institution of the suit. Admittedly, the defendants 3 and 7 are the parties to the present suit and they are not entitled to alienate the suit properties without prior permission of this Court in terms of mandate of Section 52 of Transfer of Property Act.
