Writ Petition is filed under Article 226 of Constitution of India, pleased to pass an order or direction or writ particularly in the nature of Writ of Certiorarified Mandamus calling for the records in connection with the rejection order Na.Ka.No.04/22 dated 05.03.2022 passed by the respondent herein and quash the same and consequently direct the respondent to give permission to conduct the Badminton-Shuttlecock tournament (B-level) forthwith.

O R D E R

The Writ of Certiorarified Mandamus has been filed to call for the records in connection with the rejection order Na.Ka.No.04/22 dated 05.03.2022 passed by the respondent herein and quash the same and consequently direct the respondent to give permission to conduct the Badminton-Shuttlecock tournament (B-level) forthwith.

2. The case of the petitioner is that he is the president of the B.M.D. Naina Maricar Memorial Tennis & Recreation Club, Parangipettai established on 20th December 1953 and that he had sought for permission to conduct a tournament and the 3rd respondent had rejected the same, stating that there is a law and order problem due to disputes between two groups. He would further submit that the petitioner and the Members are educated people and that they would conduct the tournament without any law and order problem and he would seek to set aside the order.

3. Per contra, learned Additional Public Prosecutor would submit that there are disputes between the tennis players and Badminton players belonging to the same club. In respect of the counter complaints given, enquiry is pending in C.S.R.No.98 of 2022 dated 01.03.2022 and C.S.R.No.105 of 2022 dated 03.03.2022. Further finding that the disputes between two groups is likely to cause breach of peace, the respondent had referred the matter to the District Revenue Officer, Chithambaram for enquiry. He would further submit that the District Revenue Officer had issued summons to both the parties to conduct Peace Committee Meeting on 17.03.2022. Based on the outcome of the District Revenue Officer enquiry, the respondent will take steps to grant permission to conduct the tournament.

4. Recording the same, the Writ Petition stands disposed of. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
