ORDER

This Writ Petition has been filed challenging the impugned order of the 2nd respondent dated 30.11.2023 and for a direction to the respondents to restore or reissue the patta No. 672, issued by the fourth respondent or issue appropriate orders or assignment in favour of the petitioner in respect to the vacant plot in Survey No. 8/55 in Vazhuthavur Village, Vikravandi Taluk, Villupuram District, to an extent of 00118 sq.mtr. within a time frame.

2. The learned counsel appearing for the petitioner would submit that since there is no appeal remedy is available against the impugned order, the petitioner preferred this writ petition.

3. The learned Additional Government Pleader appearing for the respondents 1 to 4 filed a counter affidavit stating that since there is an effective

alternative remedy available before the Commissioner of Land Administration, the petitioner supposed to have avail the same by way of filing appeal.

4. In view of the submissions made by the learned counsel for the respondents, the learned counsel appearing for the petitioner seeks liberty of this court to file an appeal before the Commission of Land Administration.

5. Considering the submissions made by the learned counsel appearing on either side, this Writ Petition is closed granting liberty to the petitioner to approach the Commissioner of Land Administration by way of filing appeal against the impugned order within a period of three weeks from the date of receipt of a copy of this order. If any such appeal is filed, the Authority concerned shall dispose of same, in accordance with law, within a period of twelve weeks from the date of filing of such appeal. No costs. Consequently, connected miscellaneous petition is closed.

6. Registry is directed to return the original impugned order copy to the petitioner.
