ORDER

This Writ Petition is filed seeking to issue a Writ of Mandamus directing the respondent to consider the petitioner application/ representation dated 21.09.2023 for sub division and issuance of separate sub division Patta in respect of petitioner's land to an extent of 2 cents in S.F.No.61/11A, vadakurumbur Village from the joint Patta bearing Patta No.718 within a time frame fixed by this Court.

The learned counsel for the petitioner submitted that he made an application/representation dated 21.09.2023 for sub division and issuance of separate sub division Patta and also paid the requisite charges through E-Challan on the same day. However, the same has not been considered so far. Hence, the present Writ Petition is filed.

3. Mr.T.Arun Kumar, learned Additional Government Pleader takes notice for the respondent.

4. Having regard to the submissions made by the learned counsel on either side and since this writ petition is filed seeking a simple writ of 2/5

mandamus to consider the petitioner's application/representation, this Court without expressing any opinion with regard to the merits of the case, directs the respondent to consider the petitioner's application/representation dated 21.09.2023 and issue notice to the petitioner and to the adjacent land owners of the four boundaries of the subject property and also to the interested parties/rival claimants/objectors/aggrieved parties if any, as the case may be and conduct enquiry in the manner known to law and pass orders on merits and in accordance with law. The said exercise shall be completed within the time as prescribed in the circular No.R1/2005632/2022 dated 17.07.2023 issued by the Commissioner of Land Administration.

5. With the above directions, this Writ Petition is disposed of at the admission stage itself. There shall be no order as to costs. 29.02.2024 ksa-2 Index : Yes / No Speaking Order : Yes / No 3/5
