ORDER
This writ petition has been filed for a mandamus seeking for a direction to the respondents 2 and 3 to rectify the FMB sketch for the property morefully described in the prayer to this writ petition, based on the petitioners' representation dated 11.08.2023 within a time frame to be fixed by this Court.
2. There seems to be a dispute between the petitioners and the fourth respondent with regard to the FMB sketch for the property morefully described in the prayer to this writ petition.
3. The fourth respondent has been duly served with notice in this writ petition. His name is also printed in the cause list today. But, he has chosen not to enter appearance in this writ petition. Hence, the fourth respondent is set exparte by this Court.
4. The petitioners seek for rectification of FMB sketch pertaining to the property morefully described in the prayer to this writ petition. The petitioners have given a representation on 11.08.2023 to the respondents 2 and 3 for the said purpose. Since the said representation has not been considered till date, the petitioners have filed this writ petition.
5. No prejudice would be caused to the second and third respondents if the petitioners' representation dated 11.08.2023 is considered on merits and in accordance with law after hearing the objections of the fourth respondent as well as the neighbouring land owners and any other third party whom the second and third respondents deem fit to enquire within a time frame to be fixed by this Court.
6. This Court is not expressing any opinion on the merits of the petitioners' representation dated 11.08.2023.
7. For the foregoing reasons, this writ petition is disposed of by directing the second and third respondents to pass final orders on merits and in accordance with law on the petitioners' representation dated 11.08.2023 seeking for rectification of FMB sketch for the property morefully described in the prayer to this writ petition within a period of twelve weeks from the date of receipt of a copy of this order after hearing the objections of the fourth respondent as well as the neighbouring land owners and any other third party whom the fourth respondent deems fit to enquire. No Costs. Consequently, connected miscellaneous petition is closed.
