ORDER
This Writ Petition is filed seeking to issue issue a Writ of Mandamus directing the first respondent to consider petitioner's representation dated 29.09.2023 and dispose the same within the time stipulated by this Court.
2. The case of the petitioner is that when the petitioner had approached the Sub Registrar to refund the excess registration charges which was paid at the time of execution of sale deed on 03.05.2023, the petitioner was asked to send a representation to the respondents 1 and 2 2/6
herein and based on which, the petitioner made a representation dated 29.09.2023. Subsequently, the respondents 1 and 2 vide their communications, directed the District Registrar, Coimbatore/4th respondent herein to consider the petitioners' representation and answer as per rule 180 of the Registration Rules. However, till now no action has been taken. Hence, the present Writ Petition is filed.
3. Mr.A.Selvendran, learned Special Government Pleader takes notice for the respondents.
4. Having regard to the submissions made by the learned counsel on either side and since this writ petition is filed seeking a simple writ of mandamus to consider the petitioners' representation, this Court without expressing any opinion with regard to the merits of the case, directs the 3rd respondent to consider the petitioners' representation dated 29.09.2023 and after issuing notice to the petitioner and conducting enquiry in the manner known to law, pass orders on merits and in accordance with law within a 3/6
period of eight weeks from the date of receipt of a copy of this order.
5. With the above directions, this Writ Petition is disposed of at the admission stage itself. The connected miscellaneous petition is ordered subject to payment of separate Court Fee by each of the petitioners.
6. There shall be no order as to costs.
