VELMURUGAN CRIMINAL MISCELLANEOUS PETITION No.8477 of 2021 IN CRL.RC.No.387 OF 2020 M.JAGANNATHAN [ PETITIONER ] Vs P.RICHARD [ RESPONDENT ] Petition praying that in the circumstances stated therein the High Court will be pleased to extend the time for complying with the conditions of the order passed in Crl.MP.No.2882/2020 in Crl.RC.No.387 of 2020 dated 12/03/2020.
Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S A.RAMASWAMY Advocate for M/S.K.BALASUBRAMANIAM, Advocate for the petitioner and of M/S AMAR D.PANDIYA Advocate on behalf of the Respondent the court made the following order:- The Criminal Miscellaneous Petition has been filed to extend the time for complying the conditions passed by this Court in Crl.M.P.No.2882 of 2020 in Crl.R.C.No.387 of 2020 dated 12.03.2020 directing the petitioner to deposit 30% of the compensation amount awarded by the trial Court to the credit of STC No.17 of 2016 before the trial Court on or before 08.04.2020.
2. The learned Counsel for the petitioner would submit that due to Covid -19 pandemic situation and thereafter, the petitioner met with an accident and admitted in the hospital and thereby the petitioner was unable to comply with the conditions within the time stipulated by this Court. Thereafter, on 22.02.2021 when he approached the trial Court by filing a memo showing his willingness to deposit the amount, the trial returned the same stating that there is no privilege from 08.02.2021 onwards. Hence, he prays for extension of time to comply with the conditions.
3. Heard the learned Government Advocate (Crl.Side) appearing for the respondent police.

It is seen that this Court by its order dated 12.03.2020 has granted suspension of sentence by imposing condition as stated above, but, even after the laps of one year, the petitioner has not taken any effective steps to comply with the order of this Court and now filed this miscellaneous petition seeking extention of time. Hence this Court is not inclined to grant any extention of time to comply with the order of this Court. Accordingly, this miscellaneous petition is dismissed.
