Prayer:- Second Appeal filed under Section 100 of the Civil Procedure Code against the judgment and decree 09.04.2009 in A.S.No.83 of 2007 passed by the learned Subordinate Judge, Ranipet, Vellore, confirming the judgment and decree dated 30.07.2007 in O.S.No.196 of 2001 passed by the learned District Munsif, Sholingur.

J U D G M E N T

The learned counsel for the appellants has filed a memo stating that the first appellant/Thomas and the sole respondent/Panjali Ammal died long back. The second appellant is not willing to contest this Second Appeal. Hence, they seek permission of this Court to withdraw this Second Appeal.

The learned counsel for the appellants has submitted the said memo along with a letter of the second appellant and also made an endorsement to that effect.

In view of the same, this Second Appeal is dismissed as withdrawn. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
