Respondent PRAYER: Writ Petition is filed under Article 226 of Constitution of India praying to issue Writ of Mandamus directing the respondents to forbear from calling for counselling or appointing persons whose names were not included in the list published on 08.06.2012 of successful candidates in the written examination called for interview for appointment by direct recruitment to the posts included in Combined Subordinate Service Examination-I (Group-II Service) and consequently direct the 1/5

respondents to call the petitioner for counselling and appoint him to the said post.

Heard, the learned counsel appearing on either side. 3.

The petitioner is a degree holder. The respondent issued 2/5

notification thereby called for applications for appointment to Government service by direct recruitment for the posts specified therein, wherein recruitment to the said posts was on the basis of written examination and oral test. The petitioner had attended the written examination on 30.07.2011. However, he was not called for interview though he scored 225 marks in the written examination and cut off mark for admission to the non-OT posts included in CSSE-I is 225. 4.

On perusal of the counter filed by the respondent revealed that she had obtained 225 marks in the written examination. The mark obtained by the last candidate who had been summoned for oral test under SC (W) category for common degree post is 225. The petitioner had scored the same cut off marks of the last candidate under SC (W) and since the petitioner, by virtue of age is junior to the last candidate summoned for non-OT posts under SC (W) category. Therefore, the petitioner had not reached the zone of selection to be summoned for oral test.

5. As such, the direction sought for in this writ petition cannot be considered and the writ petition is devoid of merits. Accordingly, this writ petition is dismissed.
