ORDER

The petitioner, who apprehends arrest by the respondent police for the offence punishable under Section 303(2) of BNSS Act 2023 and Section 21(1) of Mines and Minerals (Development and Regulations) Act 1957, in Crime No.6 of 2026, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner is alleged to have

involved in illegal transportation of 1 unit of gravel soil in a tipper lorry bearing Reg.No.TN 61 1716, without any valid license. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case by the respondent police. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that petitioner has transported 1 unit of gravel soil in a tipper lorry and the same has been seized from him. Hence, she opposed to grant anticipatory bail to the petitioner.

5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) and perused the materials available on record.

6. Considering the facts and circumstances of the case, nature of allegations and the submissions made by the learned counsel on either side, and the fact that the petitioner had indulged in illegal transportation of 1 unit of gravel sand violating the Mines and Minerals Rules and causing damage to the ecology, this Court Court is not inclined to grant anticipatory bail to this

petitioner.
