ORDER

Seeking a direction to the first respondent/police to register the FIR on the complaint dated 20.09.2014 given by the petitioner herein against the second and the third respondents pending on his file, the petitioner has come up with this petition. 2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the first respondent police.

3.The learned Additional Public Prosecutor submits that the complaint dated 20.09.2014 given by the petitioner was enquired into and it was closed as the opposite party had given an undertaking that they will pay the money. Now, it is alleged that the opposite party have taken away the lorry belonging to the petitioner.

4.Under such circumstances, the petitioner is directed to give a fresh complaint, on such complaint being given the same shall be enquired into and action shall be taken in accordance with law laid down by the Honourable Apex Court in Lalita Kumari vs. Govt. https://hcservices.ecourts.gov.in/hcservices/

of U.P. & others reported in (2014) 2 SCC 1.

4. This Criminal Original Petition is closed with the above direction.
