ORDER

This Contempt Petition has been filed alleging willful disobedience of the order issued by this Court dated 19.08.2015 in M.P.No.1 of 2015 in W.P.No.25521 of 2015.

2. Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader appearing for the respondents.

3. Today, when the matter is taken up for hearing, Mr.Sekhar Sarkar, Sub Inspector of Police, Topsia Police Station, Kolkatta and Bikram Bargi, who was earlier Sub Inspector of Police, Topsia Police Station and presently posted as Sub Inspector of Police, Patuli Police Station, Kolkatta, are present

4. Mr.Bikram Bargi, Sub of Inspector of Police, Patuli Police Staiton, Kolkatta has filed an affidavit before this Court, wherein he has stated as follows : " Pursuant to the order of this Hon'ble Court there was no investigation progressed in respect of FIR No.136 of 2012 of Topsia Police Station, Kolkata Police, West Bengal

and have not interfered with the petitioner's liberty nor raided any of the premises of the petitioner in Madras after the Interim Stay order.

Therefore, I am praying that I have not disobeyed the order of this Hon'ble Court, I have not committed any act of contempt."

5. On enquiry made by the Court, both the Sub Inspectors of Police stated that after stay was granted by this Court, they have not done anything further in the investigation of the case and they also undertook that the Topsia Police will not proceed further until orders are passed by this Court.

Recording their submissions, this Contempt Petition is closed and they are discharged.
